1. About us and these terms
These terms apply to all services provided by LDS Recovery and Services, whose address is 195 Wood Street, London, E17 3NU. You can contact us on 07520 682994 (24 hours) or by email at ldsservicesuk@gmail.com.
In these terms, “you” means the person or business booking our services, and “consumer” means an individual acting for purposes wholly or mainly outside their trade, business or profession. Some terms apply differently to consumers and business customers, and this is made clear where relevant.
2. Our services
We provide vehicle breakdown recovery, roadside assistance, accident recovery, vehicle transportation, collection and delivery, and recovery services for businesses, fleets, garages and dealerships across the UK, subject to availability.
We will carry out our services with reasonable care and skill. We may decline or stop a job if we reasonably believe it is unsafe, unlawful, or beyond the capability of our equipment, for example because of the vehicle’s location, weight, size or condition. If this happens, we will explain why and you will not be charged for work we have not done, other than any call-out charge agreed in advance.
3. Quotes and bookings
- Our prices are based on the information you give us, including the vehicle’s location, make, model and condition, the destination and the timing of the job.
- A contract is formed when we confirm that we will carry out the job at the agreed price, by phone, text, email or in writing.
- Please make sure the information you give us is accurate. If the circumstances turn out to be materially different (for example the vehicle is in a different place, has no keys, has locked wheels or steering, needs extra equipment, or is heavier than described), we will tell you about any additional charge before carrying out the extra work, and you can choose whether to proceed.
4. Prices and payment
- All prices are in pounds sterling (GBP).
- Unless agreed otherwise, payment is due on completion of the job. For pre-booked transportation and collection or delivery, we may ask for full or part payment in advance.
- We accept debit and credit cards. Card payments are processed securely by our third-party payment provider; we never see or store your full card details. We may send you a secure payment link by text or email.
- Business customers with an agreed account will be invoiced, and invoices are payable within the period stated on the invoice. We may charge interest on late payments by business customers under the Late Payment of Commercial Debts (Interest) Act 1998.
- If payment is not made, we may retain the vehicle until the outstanding amount is paid, where the law allows us to do so.
5. Arrival and delivery times
Any arrival, collection or delivery time we give is our best estimate. Traffic, weather, road closures, accidents and other jobs can cause delays. We will keep you updated if we are running late, but we are not responsible for delays outside our reasonable control.
6. Your responsibilities
When you book our services, you confirm that:
- you are the owner of the vehicle, or you are authorised by the owner to arrange its recovery or transportation;
- you have told us about anything that could affect the job, such as known faults, damage, leaks, a missing key, an electric or hybrid drivetrain, or modifications;
- you, or someone you nominate, will be available at the collection and delivery addresses, and that we can safely and lawfully access the vehicle; and
- the vehicle does not contain anything illegal or dangerous.
For your safety, please follow our instructions at the roadside and wait in a safe place away from traffic.
7. Your vehicle and belongings
- We may note and photograph the condition of your vehicle at collection. We are not responsible for pre-existing damage, existing mechanical or electrical faults, or wear and tear.
- Please remove valuables and personal belongings before the vehicle is loaded. We are not responsible for items left in a vehicle unless loss or damage is caused by our negligence.
- Please check your vehicle on delivery and tell us about any concern as soon as possible, ideally before our driver leaves.
8. Waiting time and storage
If we cannot complete a collection or delivery because nobody is available, access is not possible or the destination refuses the vehicle, we may charge for reasonable waiting time, return journeys, re-delivery or storage. We will tell you about these charges before they are incurred wherever possible.
9. Cancellations and refunds
Cancellations and refunds are covered in our Refund & Cancellation Policy, which forms part of these terms.
10. Your consumer rights
If you are a consumer, you have legal rights under the Consumer Rights Act 2015, including the right for our services to be carried out with reasonable care and skill. If they are not, you can ask us to put things right or, if that is not possible, ask for a price reduction. Nothing in these terms affects your statutory rights. For advice, contact Citizens Advice.
If you book by phone or online, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you a 14-day right to cancel. If you ask us to start the service within those 14 days (as is usual for emergency recovery), you must pay for the services provided up to the time you cancel, and you lose the right to cancel once the service has been fully performed.
11. Our liability
- We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law.
- If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for any business losses.
- If you are a business customer: we are not liable for loss of profit, revenue, business or goodwill, or for any indirect or consequential loss, and our total liability for any job is limited to the price paid for that job, except where liability cannot be limited by law.
12. Complaints
If you are unhappy with our service, please contact us as soon as possible by phone on 07520 682994 or by email at ldsservicesuk@gmail.com. We will acknowledge your complaint promptly, investigate it fairly and aim to give you a full response within 14 days.
13. Events outside our control
We are not responsible for delays or failure to perform caused by events outside our reasonable control, such as severe weather, road closures, police instructions, accidents or vehicle breakdowns. If this happens, we will contact you as soon as possible and, where a service cannot be provided, refund any payment for services not performed.

15. General
- We may update these terms from time to time. The terms in force when you book will apply to your job.
- If any part of these terms is found to be unenforceable, the rest will remain in effect.
- Nobody other than you and us has any right to enforce these terms.
- These terms are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
